Retirement from a professorship (release from the obligation to perform official duties) is not synonymous with retirement in the usual sense. Professors who were appointed before a specific deadline, which varies from federal state to federal state, enjoy a special right concerning their retirement from a professorship (deadline in Berlin: 01.01.1979, and in other federal states: 29.01.1976).

Completion of the 68th year of life represents the standard age for release from the obligation to perform official duties (retirement from a professorship). Upon application it is also possible to be released from the obligation to perform official duties upon completion of the 65th year of life. Retirement is similarly only possible upon application. The age limit for the release from obligation to perform official duties applies here and not the age of retirement. Application can, however, also be made for retirement to take effect from the normal age limit for retirement (completion of the 65th year of life).

Being released from the obligation to perform official duties does not affect the general status regarding civil service law. However, taking retirement marks the end of the civil service status. Professors continue to be members of the university even after being released from the obligation to perform official duties, albeit without the right to vote on university matters. They continue to hold office according to status law and can continue to use the title "university professor" without appending any of the German terms denoting retirement from office. In a functional sense the office of professor can continue to be exercised.

The remuneration for a professor retiring from professional duties (emeritus payments) will be made on the basis of the civil service and remuneration laws on the day prior to the transfer to the new remuneration system. Increases in remuneration occurring between the time of the transfer to the new system until the release from the obligation to perform official duties are to be taken into account for the calculation of the emeritus payments. The emeritus payments are based on the basic salary, including, if applicable, the special basic salary (due to the professor on the day before the introduction of the new remuneration system), local bonus /family supplement and other pensionable remuneration (e.g. pensionable supplement to the basic salary). Pensionable supplements to the basic salary as part of appointment or retention agreements in accordance with no. 2 of the preliminary remarks of the Federal Civil Service Salary Regulations C which were approved after the introduction of the new remuneration system  are, however, not taken into account when calculating the emeritus payments.
