A works agreement is a public service contract concluded between the responsible university authority and the staff council, in other words the staff representative for the relevant section.
Works agreements can be concluded in areas where the staff council has a right of co-determination and where the issues involved are not conclusively defined by law or collective agreements, unless the collective agreement expressly permits a works agreement.
Works agreements result from commonly-taken decisions of the responsible university authority and the staff council. On the part of the staff council, an operative decision of the entire staff council is required. In order to be effective, works agreements must always be recorded in writing and signed by both the responsible university authority and the chair of the staff council. Works agreements are to be published according to the common practice of the department (e.g current communications, circulars).
